抄録

In the digital economy, ‘big data’ plays a significant role and can add value to existing services and facilitate entirely new business models. Our digital economy depends and will depend more and more on data. The existing legal instruments - such as, copyright law, unfair competition law, sui generis right for non-original database, and contract law - can protect big data in certain cases. The question is whether to have a particular legal instrument for big data protection by, for example, introducing ‘data producer’s right’, reforming the sui generis right for non-original database, or reforming trade secret protection.
